Broadcast Microwave Services (BMS, LLC) Products Warranty
BMS, LLC warrants that, at time of delivery, the equipment covered by these terms and conditions will be free from defects in materials and workmanship, provided the equipment or system is installed, operated and maintained in accordance with the Operation and Maintenance manual or such other BMS, LLC documentation as may be applicable, for any such defect reported to BMS, LLC within 2 (two) years from the date of Delivery. BMS, LLC will take commercially reasonable and prompt action to repair or replace such equipment.
Any claim of defect shall be submitted promptly in writing to BMS, LLC Attention: Customer Service Department or e-mailed to support@BMS-Inc.com. A Return Material Authorization (RMA) is required for all items returned to BMS, LLC for repair, and must be provided by BMS LLC prior to delivery at the factory. No items will be accepted without an RMA. Information necessary to process an RMA include Buyer contact details, full product identification (serial number, model number), and description of the claimed defect as well as an explanation of the circumstances, operational conditions, and readings at the time of defect.
BMS, LLC’s total liability under this warranty program is limited to the repair or replacement of items purchased pursuant to these terms and conditions, which are found to be defective in material, workmanship, and/or design if the product was designed by BMS, LLC. BMS, LLC retains the option to make such repair or replacement at Buyer’s site, at the BMS, LLC factory, or via an authorized service center.
BMS, LLC-supplied subsystems from other OEM manufacturers are covered under this standard warranty for a period of 2 (two) years from the date of delivery. For OEM equipment, warranty is provided for defects in material and/or workmanship but not in cases of defective design or feature-set. Additionally, the integration of components in the system in terms of functionality, not related to design or feature-set, is also covered under the standard 2 (two) year warranty. BMS, LLC assumes no liability beyond repair or replacement of OEM equipment.
Expendable items such as bulbs, fuses, etc., are excluded from coverage under this warranty program.
Buyer shall be responsible for all costs of returning claimed defective products to BMS, LLC and BMS, LLC will be responsible for returning the repaired products or replacements.
BMS, LLC SHALL HAVE NO RESPONSIBILITY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OF ANY KIND, WHATSOEVER.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
